What is a Warrant? It is the given generic term, in Chile, to the operations guaranteed with physical goods through a legal instrument called “Certificate of deposit and Bond", ruled by Law 18,690 on General Warehouse of Deposits.
Who operates with Warrants? Any natural person or legal entity can operate with this instrument through a company of General Warehouse of Deposit (STORAGE S.A.)
Who finances a Warrant? Any financial institution, private or state-owned, national or international.
What can be given in Pledge? Any product, raw material or merchandise, of national or foreign origin.
Where are these Pledges kept?
They can be stored in STORAGE S.A. precincts, authorized as General Warehouse of Deposit or, if required by the depositor, STORAGE S.A. can constitute determined areas in authorized precincts to for the Pledge custody.
Who valorises the goods given in Pledge? The goods given by the depositor are valorised by the pledge creditor and the warehouse company (STORAGE S.A.), considering both market value and potential liquidity.
How is a Warrant guaranty constituted? By endorsement of the Pledge in favour of a natural person or legal entity, and the registration of this in the warehouse company records.
How is a Warrant guaranty released? By the total or partial payment of the obligation guaranteed by the Bond. Not always a partial release granted by the pledge creditor is in response of a partial cancellation, since it can be caused by documents that satisfy the financier’s guarantees.
